The following questions are designed to allow the Intellectual Property Management Office (IPMO) to identify and assist you in protecting and commercializing the resulting intellectual property as required by University policy (University of Oklahoma Faculty Handbook, Norman Campus, Section 3.27).

A patent is a grant issued by the U. S. Patent and Trademark Office (PTO) that provides the assignee of the patent the right to keep others from practicing or using its patented invention. Patents are issued for inventions that are novel (not published, sold, or utilized for more than one year), useful (the invention is useful and not just a subject for additional research), and non-obvious to others of ordinary skill in the art. (In almost all foreign countries, to be patentable, an invention requires complete novelty. In others words, it cannot have been published, used, sold, or bartered publicly prior to the filing of a patent application either in the country itself or in the United States PTO.)

Copyright is a form of legal protection available for works of creativity, including but not limited to original works of art and/or authorship that are fixed in a tangible form. Examples of copyrightable material include books, journal publications, and software. Under University policy, scholarly works are the property of the author, while copyrightable works of a commercial nature inure to the benefit of the University.
